01Agreement to these Terms

These Terms of Service (the "Terms") are an agreement between you and MorganDesigns ("we", "us") covering your use of ProBot (the "Bot"), a Discord application with the application ID 1567575605061484685, and the web dashboard at probot.morgan-lee.dev (the "Dashboard"). Together they are the "Service".
By using any part of the Service, which includes interacting with the Bot's commands, buttons, forms, tickets or giveaways in the Pro Modz Discord server (the "Server"), or signing in to the Dashboard, you agree to these Terms. If you do not agree, do not use the Service.
You must also comply with Discord's Terms of Service and Community Guidelines, and with the Server's own rules. Our Privacy Policy explains how we handle your data and forms part of these Terms.

02The Service

ProBot is a single-server Discord bot operated by us at the request of the Server's owner. It provides member verification, welcome messages, self-assignable role menus, moderation and logging tools, automatic spam, scam-link and raid protection, anti-nuke protection, support and purchase tickets, giveaways, server statistics channels, YouTube upload announcements, and a Dashboard for Server staff to configure all of this.
The Server's owner and staff decide which features are switched on and how they are configured. We may add, change or remove features at any time. The Bot is not available to be added to other Discord servers.

03Who may use it

  • You must meet Discord's minimum age, which is 13 or higher where your local law requires it, and be allowed to use Discord.
  • The Dashboard is only for Server staff who have been granted access by the Server's owner. Signing in without that authority, or sharing your access with others, is not permitted.
  • If you use the Service as a member of Server staff, you confirm that you have the authority to accept these Terms for the actions you take.

04Acceptable use

You agree not to:
  • attempt to bypass verification, automatic moderation, anti-raid protection or any other safety feature;
  • use alternative or automated accounts to enter giveaways more than once, inflate invite counts or evade punishments;
  • spam commands, exploit bugs or rate limits, or otherwise interfere with the Bot's operation;
  • use tickets, role menus or any other feature to post unlawful, harassing, hateful or sexually explicit content, or to advertise without the Server's permission;
  • probe, scrape or attempt to access the Dashboard, the Bot's internal API or its data without authorisation;
  • if you are Server staff, use the Dashboard to collect or disclose members' data for anything other than running the Server.
If you find a security problem, please tell us privately using the contact details below rather than exploiting or publicising it.

05Moderation and automated actions

The Bot takes some actions automatically based on rules set by Server staff. It may delete messages, time out, quarantine, kick or ban accounts that spam, post scam links, take part in raids or perform mass destructive actions, and it may lock the Server down during a raid. Server staff can review and reverse these actions.
Decisions about your membership of the Server are made by the Server's owner and staff, not by us. Appeals should go to Server staff through a ticket or whatever channel the Server provides. We are not responsible for moderation decisions taken by Server staff.

06Giveaways

  • Giveaways are run by Server staff, who choose the prize, the duration and any entry requirements shown on the giveaway message. We provide the tool; we do not supply, fund or guarantee any prize.
  • One entry per person. Entries from alternative or automated accounts, or that break the Server's rules, may be removed and the winner rerolled.
  • Winners are chosen at random from the eligible entries. A winner must respond within the claim period stated on the giveaway, otherwise the prize may be rerolled.
  • Prizes have no cash alternative unless the host says otherwise. Prizes that involve third-party games, platforms or accounts are subject to those third parties' terms, and we accept no responsibility for them.
  • Giveaways are not sponsored, endorsed or administered by Discord, Google, YouTube or any game publisher.

07Tickets and purchases

Tickets are a private channel between you and Server staff. Anything you are offered or agree to buy in a ticket is a transaction between you and the person selling it. We do not process payments, we are not a party to the transaction, and we are not responsible for any goods, services, accounts or in-game items that are promised, delivered or not delivered.
Ticket channels are recorded and a transcript is kept as described in the Privacy Policy. Do not share passwords, payment card numbers or other sensitive information in a ticket.

08Availability and changes

The Service is provided free of charge, "as is" and "as available". We aim to keep it running, but we do not promise that it will be uninterrupted, error-free or available at any particular time. It depends on Discord, YouTube and our hosting provider, and it may be paused for maintenance or updates without notice.
We may change or discontinue the Service, or any part of it, at any time. Where practical we will give the Server's owner notice first.

09Intellectual property

The Bot and the Dashboard, including their code, design and text, belong to us. You may not copy, modify, reverse engineer or redistribute them except where the law allows. You keep the rights to the content you post. By using the Service you allow us to process that content as needed to provide the features described above.
"ProBot" is our project name. Pro Modz, Discord, YouTube and the names of any games mentioned on the Server are trademarks of their respective owners. We are not affiliated with or endorsed by Discord Inc., Google LLC, Rockstar Games or Take-Two Interactive.

10Liability

To the fullest extent permitted by law, we exclude all warranties and will not be liable to you for any indirect or consequential loss, loss of data, loss of access to the Server, or any loss arising from moderation decisions, giveaway outcomes, transactions discussed in tickets, the actions of Server staff or other members, or downtime of Discord or our hosting provider.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the law of England and Wales, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep every right your local consumer law gives you.

11Suspension and termination

Server staff may restrict your use of the Bot's features, remove you from the Server or ban you under the Server's rules. We may suspend or end your access to the Dashboard, or stop providing the Service altogether, at any time, including if you break these Terms. You can stop using the Service at any time by leaving the Server.
The sections on intellectual property, liability and governing law survive termination.

12Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they last changed. If a change is material we will announce it in the Server before it takes effect. Continuing to use the Service after that means you accept the new Terms.

13Governing law

These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them. If you are a consumer living elsewhere in the United Kingdom or in the European Union, you may also rely on the mandatory consumer protection rules and the courts of the country where you live.
